The parent statute. The Migration Regulations 1994 and the Schedules live under it. Three sections matter most for the case: s 65 (the decision), s 140A (the sponsor), s 234 (the criminal-disclosure offence).

- s 46 - valid application. The application must satisfy the formal validity requirements (correct form, fees, lodgement channel) before it is even assessed against substantive criteria. Lodgement mechanics matter here.
- s 5CB - "de facto partner" definition. The Act-level definition feeds reg 1.09A.
- s 501 - character test. Independent of PIC 4001; Ministerial discretion to refuse on character grounds. Triggered by substantial criminal record or other character concerns. Not engaged by Eduardo's case.
